Terms & Conditions

There is no Buyer Premium or Buyer Transaction Fee added to the bid amount. No deposit is necessary to bid, and there are no complicated legal forms necessary to place a bid.

EasyBid Auction:
If you are the winning bidder, you agree to submit a Hawaii Association of Realtors standard form Purchase Contract offering to purchase this property at the winning bid amount, and you may include all typical contingencies in your offer and propose your desired terms such as closing date, deposit amounts, and others. Just as in a normal real estate offer, the Seller may accept, negotiate, or reject the Purchase Contract based on the terms. As in any contract, your rights and responsibilities will be governed by the Purchase Contract, and you will not be obligated to purchase the property until all conditions and contingencies have been fulfilled.

Terms and Conditions vary by type of auction. Certain auctions may have special conditions in their description, and those Terms and Conditions supercede these.

Agency Representation and Commissions:
If you are the winning bidder, you may choose to have your own Hawaii-licensed real estate agent submit your Purchase Contract and represent you. If you do not identify another agent to submit your Purchase Contract, then Elite Pacific Properties will represent you as your Agent or, in the event that Elite is the listing agent, this will be what is known as a Dual Agency. Regardless of representation, the seller or their Agent will pay Elite Pacific Properties a commission at closing, but this will not affect your purchase price.
